WALKERSVILLE BURGESS & COMMISSIONERS TOWN MEETING

March 26, 2014

The Town meeting of the Walkersville Burgess & Commissioners was called to order on Wednesday, March 26, 2014, at 7:30 p.m. Those in attendance included Burgess Ralph Whitmore, Commissioners Gary Baker, Donald Schildt, Chad Weddle, Russell Winch, and Debbie Zimmerman; Planning and Zoning Administrator Susan Hauver, Public Works Director Robert DePaola, Town Manager Gloria Long Rollins, 6 citizens, Kelsi Loos of the Frederick News-Post, David Dunn, Frederick County Municipal Liaison, Ian Bartman, Town Attorney, and TFC Gary Conklin.

The meeting was called to order with the Pledge of Allegiance and a prayer by Commissioner Chad Weddle.

1. MINUTES

Commissioner Debbie Zimmerman made a motion, seconded by Commissioner Russell Winch, to approve the Town meeting minutes of March 12, 2014. The motion passed by a vote of 5-0.

2. PUBLIC HEARING ORDINANCE 2014-01 RESERVATION OF LAND FOR RECREATION

The hearing has been postponed for a month.

 

3. OTM ZONING – MINIMUM LOT SIZE REQUIREMENT TEXT AMENDMENT

Ms. Hauver presented the Old Town Mixed Use lot size requirements as adopted in 2001. The new use for the Walkersville Market property does not utilize the entire space and the owners would like to have a second business permitted there. The size of the property is 13,031 square feet and does not meet the minimum lot size requirement for additional tenants.

Commissioner Russell Winch made a motion, seconded by Commissioner Debbie Zimmerman, to proceed with preparing a text amendment to the OTM zoning that would accommodate a second business at the Walkersville Market property. The motion passed by a vote of 5-0.

 

4. COMMUNITY ALL-SHRED EVENT

Commissioner Gary Baker presented the idea of having a shredding truck at town hall for the convenience of citizens. Commissioners agreed to check with the banks to see if they have an event scheduled and the costs of hiring the shredder on a weekday versus a weekend day.

Commissioner Donald Schildt made a motion, seconded by Commissioner Russell Winch, to set up a Community shredding day in conjunction with Bulk Trash Day on June 14, 2014. The motion passed by a vote of 5-0.

Shredding Day to be Saturday, June 14, 2014 from 9 a.m. to 12:00 p.m. The cost is $175 per hour with a 3 hour minimum. Since the cost is not by the pound, but by the hour, there is no benefit to checking ID to insure only Walkersville residents utilize the service.

5. CPR TRAINING

Commissioners agreed to set up a CPR Training day for staff. At this time, we will forego the defibrillator training.

6. KEYS GAME

Commissioner Chad Weddle made a motion, seconded by Commissioner Russell Winch, to invite staff and committee members to attend the Keys game on August 27, in lieu of having the Town picnic in July.

The motion passed by a vote of 5-0.

Commissioner Chad Weddle made a motion, seconded by Commissioner Russell Winch, to hold only one meeting, on the second Wednesday of the month, for the months of July, August, November, and December. The motion passed by a vote of 5-0.

 

7. ACCOUNTS PAYABLE

Commissioner Russell Winch made a motion, seconded by Commissioner Gary Baker, to pay the attached bills. The motion passed by a vote of 4-1, with Commissioner Chad Weddle in opposition.

 

8. COMMISSIONERS’ CONCERNS

Commissioner Gary Baker reminded everyone of the Drug Seminar, for adults only, with speaker Michael Gimbel, on Wednesday, April 2nd from 7 – 9 p.m.

Burgess Whitmore reported that water cutoff day was the usual trauma in the office, with 22 residences having the water turned off due to non-payment of the November 1st bill.

Burgess Whitmore reminded commissioners to rsvp to Ms. Rollins if they plan on attending the MML meeting at the Brick Oven in Mt. Airy on April 21st.

Burgess Whitmore presented his sidewalk replacement policy for the commissioners to read and ponder and discuss at the next town meeting.

Burgess Whitmore noted the new LED lighting on the outside of the building and asked everyone to take notice on their way out.

Commissioner Russell Winch made a motion, seconded by Commissioner Debbie Zimmerman, to hold a closed legal meeting with the Town Attorney to discuss the legal proceedings for bringing a non-compliant fence into compliance. The motion passed by a vote of 3-2, with Commissioners Donald Schildt and Chad Weddle in opposition.

Commissioner Russell Winch invited everyone to attend GVAA Baseball Opening Day on Saturday, April 5th, at 9:00 a.m. on Field #3.

 

9. CITIZENS’ QUESTIONS AND CONCERNS

Mr. George Rudy, currently in exile, reported that he has had a response from MDE regarding the MAJOR ISSUE with Valero. He will be requesting more information via the public information act. He also notified commissioners that he will be lodging a complaint against Draper Properties, 11 W. Crum Road, with 4 definitive code violations.

Donald Schildt, 1 Glade Road, asked for information on the zoning violation regarding the fence case that he won via the Board of Appeals. Burgess Whitmore informed him that the Town has been working on the legal remedy and will notify him when able.

Andrew Toms, 211 Stauffer Court, asked the Town to review the annexation agreement for the Walkersville Industrial Park on behalf of Monroe Grossnickle.

The meeting adjourned at 8:15 p.m.
